Project description:

The PhD project sets out to investigate the brutalisation of Danish prisons and LGBTI+ discrimination. No research has yet illuminated LGBTI+ people’s experiences of incarceration in Denmark, the character of discrimination faced by the group from fellow inmates, prison staff, and the prison system, or the consequences of strong prison hierarchies, increased brutalisation, and prison violence to LGBTI+ individuals. The international body of knowledge is extremely limited and through a six-month field study and several qualitative interviews, the project is expected to produce novel empirical, methodological, and theoretical insights into the lived experiences of incarcerated LGBTI+ people. The project is co-funded with the Danish Institute for Human Rights.

Project description:

This project aims to cover the interplay between an increasing amount of criminal norms laid-down at a EU-level and the Danish principle of legality, which is deeply rooted in national Danish criminal law tradition.

The interplay of norms and different legal traditions and systems give rise to a number of interesting research questions, that have so far only been partly answered by the CJEU and the Danish Supreme Court.

Comprising the role of the principle of consistent interpretation in national criminal law and the role of a germinating independent European principle of (criminal) legality rooted in Article 49 of the Charter.

Målsætningen med projektet er en vurdering af uskyldsformodningen i dansk ret, herunder om praksis fra den Europæiske Menneskerettighedsdomstol og EU-retten udvider omfanget af processuelle retssikkerhedsgarantier i Danmark, og om det danske retsforbehold risikerer at påvirke den gensidige anerkendelse mellem EU-landene.

Projektbeskrivelse:
Projektet undersøger indsattes adgang til sundhedsbehandling og har til formål at afdække afsoningsvilkårenes betydning for sundhedsbetjeningen af indsatte samt indsattes helbred. Herunder vil betydningen af de praktiske og juridiske vilkår, som fængslet er underlagt blive belyst med inddragelse af menneskerettigheder og dansk ret. Den empiriske del af projektet består af data indsamlet gennem et etnografisk feltarbejde i kriminalforsorgens institutioner. Feltarbejdet omfatter observation og interview i både arrester, lukkede og åbne fængsler.
