In the light of the Danish Competition Act and TFEU art. 101, the project examines the legality of joint bidding (consortium bids). The project entails both legal and economic analysis to shed light on the consequences of the current state of law including the legal uncertainty of the assessment of whether companies are competitors. In addition, the project seeks to provide a legal political discussion on how joint bidding could/should be regulated to create social value.

Project description:

States are increasingly cooperating to prevent access to asylum in more affluent parts of the world. Perhaps intentionally, these policies significantly challenge the existing refugee and human rights protection regime, still largely tied to notions of territory and (single) state responsibility. This project will investigate the policies of the European Union, United States and Australia. It raises two main questions. The first is legal: to what extent can international refugee and human rights law be brought to bear on international cooperation in the field of migration control and asylum processing? The second is more theoretical: what does the interplay between normative commitments and policy practices in this area tell us about the role of international law in shaping refugee policy?

Project description:

The main objective of the project is to analyse and evaluate the effects on local acceptance of wind power projects of the specific Danish policy measures in the Act on renewable energy (Consolidated Act no. 1330, Nov. 25, 2013). The project will in particular focus on the compensation scheme to neighbours, the co-ownership scheme and the community benefit scheme. These three schemes were adopted in 2008 with the purpose to increase local acceptance of wind power projects. There is, however, only limited knowledge about the actual effects of such schemes on local acceptance. The PhD project will analyse to what degree, how and why the different policy measures affect local acceptance of wind power projects. This will be valuable knowledge for the future development of such policy measures for renewable energy projects at national and international level. Recommendations to adjustments of the Danish measures may be suggested.

The PhD project is part of a multidisciplinary research project on local acceptance of wind power projects (Wind2050) funded by the Strategic Research Council.

This research intends to analyse the correlation between legal certainty and the legal standards of the CISG, and how it affects the efficiency of the international sale of goods transactions governed by the CISG. The research will focus on three main issues: the construction, interpretation and application of the legal standards of the CISG. During the research the economic analysis of law will be applied, thus giving a new perspective and contributing to the existing research.
